1. INTRODUCTION

1.1. PURPOSE OF POLICY. Mission Trails Regional Park Foundation, at mtrp.org (“MTRP,” “us,” “we,” or “Organization”) is committed to respecting the privacy rights of its visitors and other users of the Organization’s Website (the “Site”). This Website Privacy Policy (“Policy”) is designed to outline your rights regarding any of your personal information on this Site, and to demonstrate our commitment to fair information practices and the protection of privacy. This Policy is only applicable to the Site, and not to any other websites or third-party-hosted websites or other third-party information that you may be able to access from the Site, any of which may have data collection and use practices and policies that differ materially from this Policy.

 

1.2. NOTICE CONCERNING CHILDREN (COPPA).

PLEASE NOTE: We are a general audience website, and do not direct any of our content specifically at children under 13 years of age, nor do we collect personally identifiable information (PII) from children.

We do not knowingly collect personal information from children under 13. We understand and are committed to respecting the sensitive nature of children’s privacy online. If we learn or have reason to suspect that a registered Site user is under age 13, we will promptly delete any personal information in that user’s account.

 

1.3 REGISTERED USERS. While registration is not required to view our Site, some parties, such as MTRP volunteers, may be required to provide personal information as related to their capacity with MTRP, and may need to register or otherwise obtain login access to or through the Site.

We require that registered members of the Site be 18 or older. If we obtain information or otherwise have reason to believe you are not 18 or older, we will investigate further and reserve the right to terminate your account or registration.

 

1.4 WE WILL NOT SELL YOUR PERSONAL INFORMATION. MTRP may utilize information provided by you for purposes outlined in this Policy, or to the extent required to comply with the law; but otherwise, MTRP is committed to your privacy and will not sell your information to third parties for any purpose other than as outlined herein.

 

2. INFORMATION COLLECTION PRACTICES

2.1. BASIC INFORMATION COLLECTED BY COMPANY

In operating the Site, Organization may include registration forms, and other online forms that ask users to provide their names, email addresses, and other contact information, as well as a User Name.

Organization may also request profile information from you, or from your social networking profiles, for the purposes including customization, and accuracy, and other purposes designed to improve your experience on the Site.

You do not need to register or create a MTRP account if you are only visiting the Site or purchasing items on the Site.

 

2.2. ADDITIONAL INFORMATION COLLECTED BY COMPANY

(a) AUTOMATIC COLLECTION. Our servers automatically recognize visitors’ domain names and IP addresses (the number assigned to computers on the Internet). No personal information about you is revealed in this process. The Site may also gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving the services we offer.

(b) COOKIES. From time to time, we may use the standard “cookies” feature of major browser applications that allows us to store a small piece of data on your computer about your visit to our Web site. We do not set any personally identifiable information in cookies, nor do we employ any data capture mechanisms on our website other than cookies. Cookies both help improve your experience on the Site, and help us learn which areas of our site are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at our Web site may be diminished and some features may not work as they were intended.

(c) PHOTOGRAPHS AND OTHER SUBMISSIONS. Our Organization operates some participant/volunteer and other programs that allow you to provide photographs and other materials for posting online (User Content), and which request information from you such as your name and email address for identification purposes. In addition, we welcome your comments, testimonials, thoughts, and ideas, however, we will not publish such materials without your permission. If you are supplying photographs or other content to us for publication, you are granting MTRP and its authorized representatives a license to use your User Content (including your name and social media address if relevant) in connection with the operation of the Site, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content on our Site, and in social media and promotional materials. You will not be compensated for any User Content.

 

3. USE AND SHARING OF INFORMATION

3.1. COMPANY USE OF COLLECTED INFORMATION

(a) PERSONAL INFORMATION. We will not share your personal information with any third parties without your consent, except as necessary to provide you with the services offered by us or to comply with the law. We may use your personal information to verify your identity, or to follow up with communications initiated on the Site. We may also use your contact information to inform you of any changes to the Site, or to send you additional information about the Organization.

(b) ANONYMOUS INFORMATION. We use anonymous information to analyze our Site traffic, but we do not examine this information for individually identifying information. In addition, we may use anonymous IP addresses to help diagnose problems with our server, to administer our site, or to display the content according to your preferences. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.

(c) USE OF COOKIES. We currently use cookies only for analytics purposes. In the future we may use cookies to deliver content specific to your interests; to save your password, if any, but only if authorized by you; or for other purposes.

(d) DISCLOSURE OF PERSONAL INFORMATION. We may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the requirements of the law or comply with legal process served on the Organization or its subsidiaries or affiliates, (2) protect and defend the rights or property of the Organization or the users of the Site, or (3) act under exigent circumstances to protect the safety of the public or users of the Site.

(e) ACCESS TO INFORMATION. Unfortunately, we do not maintain any procedures for you to review or request changes to the information that we may have collected about you, except that you may request that we remove all information about you from our database by contacting us in accordance with Section 6.1 below.

 

4. SECURITY

The Site has security measures in place to prevent the loss, misuse, and alteration of the information that we obtain from you, but we make no assurances about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.

 

5. WEBSITE AREAS BEYOND COMPANY’S CONTROL

5.1. PUBLIC FORUMS

The Site does not host interactive features at this time, but may include links to third-party interactive forums and third-party features. Please remember that any information that is disclosed in public areas becomes public information and you should exercise caution when deciding to disclose your personal information.

 

5.2. THIRD PARTY WEBSITES

The Site may contain links to other websites. If you choose to visit other websites, we are not responsible for the privacy practices or content of those other websites, and it is your responsibility to review the privacy policies at those websites to confirm that you understand and agree with their policies.

MTRP may send parties with registration access an email notifying them of any changes to this Policy, or otherwise advise such users. Any such change, update, or modification will be effective immediately upon posting on the Site for new users, and upon notice to existing users with registration access. If you do not expressly assent to updates to this Policy, you will remain bound by the Policy in place as of the date you first assented to the Policy. It is your responsibility to review this Policy from time to time to ensure that you continue to agree with all of its terms.
